Terms of Service

Welcome to Yellowpink! These Terms of Service govern your use of our mobile application and services. Please read them carefully before using our platform.

Acceptance of Terms
By downloading, installing, or using the Yellowpink mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App or services. These Terms constitute a legally binding agreement between you and Yellowpink ("we," "us," or "our"). By accessing or using the App, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Description of Services
Yellowpink provides a mobile platform for: • Booking beauty service appointments with licensed professionals • Viewing service menus, pricing, and availability • Managing your appointment history and preferences • Accessing beauty-care tips and product information • Processing payments for services rendered through Apple's In-App Purchase system • Communicating with our staff and technicians • Subscription-based access to premium features We reserve the right to modify, suspend, or discontinue any part of the services at any time with or without notice.
User Accounts and Registration
To use our services, you must: • Create an account with accurate, complete information • Be at least 18 years old, or 13-17 with verifiable parental/guardian consent • Maintain the security of your login credentials • Update your information as needed to keep it accurate • Use the App only for lawful purposes • Not share your account with others • Not create multiple accounts • Notify us immediately of any unauthorized access Age Verification: • Users under 18 require parental consent • We may request proof of age at any time • Accounts found to violate age requirements will be terminated You are responsible for all activities that occur under your account. Keep your password secure and do not share it with anyone.
Subscription Terms and Auto-Renewal
Subscriptions purchased through the App: Payment and Billing: • Payment is processed through Apple's In-App Purchase (IAP) system • Prices are in USD (or your local currency) and may vary by region • Prices do not include applicable taxes, which are added at checkout • We reserve the right to change prices with 30 days' notice Auto-Renewal: • Subscriptions automatically renew unless canceled at least 24 hours before the current period ends • Your Apple account will be charged within 24 hours prior to renewal • Subscription duration varies by plan (monthly, yearly) • Manage subscriptions through: Settings > [Your Name] > Subscriptions on your iOS device Free Trials: • Free trial periods (if offered) are available to new subscribers only • Trials automatically convert to paid subscriptions unless canceled before the trial period ends • Previous subscribers are not eligible for additional free trials • Cancel anytime during the trial period to avoid charges Cancellation: • Cancel anytime through your Apple account settings • Cancellation takes effect at the end of the current billing period • No refunds for partial periods after cancellation • Access to subscription features continues until the end of the paid period Refunds: • Refund requests are handled according to Apple's refund policy • Contact Apple Support directly for refund requests • We do not control Apple's refund process • Refunds are at Apple's sole discretion
Booking and Appointments
When booking appointments: • All bookings are subject to staff availability • You must provide accurate contact information • Appointments are confirmed via email or SMS • Late arrivals (15+ minutes) may result in shortened services or rescheduling • No-shows may incur charges or booking restrictions • Special requests should be noted during booking • We reserve the right to refuse service for health, safety, or capacity reasons Modifications: • Reschedule or cancel appointments through the App • Changes should be made at least 24 hours in advance • Last-minute changes may not be accommodated
Payment Terms
Payment policies: • Subscription payments are processed through Apple's IAP • Service payments may be processed through Apple Pay or other approved methods • All prices are subject to change with 30 days' notice to existing subscribers • Disputed charges must be reported within 30 days • Additional charges may apply for premium services or products • Tips/gratuities are optional and appreciated Failed Payments: • Subscriptions will be suspended if payment fails • You will be notified of payment issues • Access is restored once payment is successfully processed
Cancellation and Refund Policy
Appointment Cancellation: • Cancel at least 24 hours in advance to avoid fees • Same-day cancellations may incur a 50% service charge • No-shows will be charged the full service amount • Weather-related cancellations are handled case-by-case • Emergency cancellations will be reviewed individually • Repeat cancellations may result in booking restrictions Subscription Refunds: • Handled exclusively through Apple's refund process • Request refunds through: reportaproblem.apple.com • We cannot directly process refund requests • Refunds are granted at Apple's sole discretion • Contact us if you have questions, but Apple handles the final decision
Acceptable Use Policy
You agree NOT to: • Violate any laws or regulations • Infringe on intellectual property rights • Upload malicious code or viruses • Harass, abuse, or threaten others • Impersonate any person or entity • Collect user information without consent • Interfere with or disrupt the service • Use automated systems (bots, scrapers) without permission • Reverse engineer or attempt to extract source code • Resell or redistribute the App or its content • Use the service for any fraudulent purpose Violations may result in immediate account termination and legal action.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: Service Limitations: • Services are provided "AS IS" without warranties of any kind • We do not guarantee uninterrupted or error-free service • We are not liable for allergic reactions to products used • Clients must disclose allergies and medical conditions • Individual results from services may vary • You participate in services at your own risk Liability Limits: • Our maximum liability is limited to the amount you paid in the 12 months prior to the claim • We are not liable for indirect, incidental, or consequential damages • We are not responsible for personal items lost or damaged on premises • Force majeure events (natural disasters, pandemics, etc.) are beyond our control Third-Party Services: • We are not responsible for third-party services (Apple, payment processors) • Third-party services have their own terms and conditions • Links to external sites are provided for convenience only SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
Intellectual Property
All app content is protected: • The App, website, and all content are our intellectual property • Content includes text, images, designs, logos, code, and trademarks • You may not copy, modify, distribute, or create derivative works • You are granted a limited, non-exclusive, non-transferable license to use the App • License terminates upon account closure or violation of Terms User Content: • You retain ownership of photos and content you upload • By uploading, you grant us a worldwide, royalty-free license to use your content for: - Providing services - Promotional purposes (with your consent) - Service improvement and analytics • You can revoke consent by contacting us • You represent that you have rights to all uploaded content • We may remove content that violates these Terms Feedback: • Feedback, suggestions, and ideas you provide may be used freely • No compensation will be provided for feedback • We are not obligated to use or implement feedback Trademarks: • "Yellowpink" and our logos are our trademarks • Third-party trademarks belong to their respective owners • Do not use our trademarks without written permission Copyright Infringement: • Report copyright violations to: hz019533@gmail.com • Include: description of work, location of infringement, contact info, good faith statement • We will investigate and remove infringing content as appropriate
Account Termination
We may suspend or terminate accounts for: • Violation of these Terms of Service • Fraudulent, abusive, or illegal behavior • Failure to pay for services • Providing false or misleading information • Harassment of staff or other users • Security threats or misuse of the service • Repeated cancellations or no-shows • Extended period of inactivity (1 year+) Termination Process: • We will attempt to notify you before termination • You may appeal termination decisions • Upon termination, your access is immediately revoked • You remain liable for any outstanding charges Your Rights: • You may terminate your account at any time through Settings • Request data export before termination • Deleted accounts cannot be recovered • Subscription charges continue until canceled through Apple
Dispute Resolution and Governing Law
Governing Law: • These Terms are governed by the laws of the State of California, USA • Without regard to conflict of law principles • Federal arbitration law governs arbitration provisions Dispute Resolution Process: 1. Informal Resolution: Contact us first to resolve disputes amicably (30 days) 2. Mediation: If unresolved, parties agree to mediation 3. Binding Arbitration: Disputes will be resolved through binding arbitration - Administered by American Arbitration Association (AAA) - Held in San Francisco, California or via video conference - Conducted in English - Arbitrator's decision is final and binding - Cost shared equally between parties Arbitration Exceptions: • Small claims court (claims under $10,000) • Intellectual property disputes • Emergency injunctive relief Class Action Waiver: • You waive the right to participate in class action lawsuits • Claims must be brought individually • No class-wide arbitration permitted 30-Day Opt-Out: • You may opt out of arbitration by emailing hz019533@gmail.com within 30 days of account creation • Include your name, email, and statement opting out of arbitration • Opting out does not affect other Terms provisions Jurisdiction: • For non-arbitrable disputes, courts in San Francisco County, California have exclusive jurisdiction • You consent to personal jurisdiction in these courts
Changes to Terms
We reserve the right to modify these Terms at any time: • Changes will be posted in the App and at our website • Material changes will be notified via email or push notification • Continued use after changes constitutes acceptance of new Terms • If you don't agree to changes, stop using the service and contact us • Previous versions will be archived and available upon request • You should review Terms periodically for updates Notification of Changes: • Email notification for significant changes • In-app notification banner for 30 days • "Last Updated" date shown at top of Terms
General Provisions
